Court accepts virtually commissioned affidavits
The High Court has accepted affidavits commissioned virtually while a Commissioner of Oaths was present. The High Court accepted the definition provided in the new Shorter Oxford Dictionary which inter alia states that the phrase “in the presence of” suggests “in the company of, observed by”. The Court further agreed “that the courts must open themselves to the modern trend of technology”. para 32 in Ed Foods SRL v Africa’s best (Pty) Ltd, Case No 2022/1245 (14 March 2024).
